  2.       for Antiviral Toolkit Virus Encyclopedia ("AVPVE")
  3.                       by Eugene Kaspersky

  6. AntiViral Toolkit Pro Virus Encyclopedia ("AVPVE"), and
  7. accompanying documentation are to be considered FREEWARE. You
  8. are hereby granted a license by KAMI Ltd. to distribute the
  9. freeware copy of AVPVE and its documentation, subject to the
  10. following terms and conditions:

  12. The FREEWARE package of AVPVE must be distributed freely
  13. without any charge.
  14.  
  15. AVPVE may not be bundled or included with any hardware or
  16. software without the expressed written consent of KAMI Ltd. or
  17. any authorized distributor.

  19. The distribution archive must be distributed in complete form.
  20. The individual files must also be complete and unmodified. The
  21. distribution archive must be without any additional files. ONLY
  22. AUTHORIZED DISTRIBUTORS are granted authority to modify or add
  23. files to the distribution archive.  The documentation and files
  24. must be distributed together. Any modifications to the package,
  25. including the addition of BBS advertisements is strictly
  26. forbidden.

  28. AVPVE may not be sold or licensed. No fee may be charged for
  29. its use.  If a fee is charged in connection with AVPVE at all,
  30. it should only cover the cost of copying or distribution. UNDER
  31. NO CIRCUMSTANCES should payment of such fees be understood to
  32. constitute legal ownership.

  34. By granting you the right to distribute the freeware copy of
  35. the AVPVE, you do not become the owner of these utilities or
  36. documentation in any form.

  38. KAMI Ltd. hereby disclaims all warranties relating to
  39. Antiviral Toolkit Pro Virus Encyclopedia by Eugene V. Kaspersky
  40. (c) KAMI Ltd. whether express or implied, including without
  41. limitation any implied warranties of merchantability or fitness
  42. for a particular purpose. The person, company, institution, or
  43. government agency using AVPVE bears all risk as to the quality
  44. and performance of AVPVE. In no event shall KAMI Ltd., any
  45. distributor of AVPVE or anyone else involved in the creation,
  46. production, distribution or delivery, of AVPVE, be liable for
  47. any damages of any kind, including without limitation direct,
  48. indirect, consequential, incidental, special, or exemplary
  49. damages arising out of the use, performance, or delivery of
  50. AVPVE even if KAMI Ltd. any distributor, or anyone else
  51. involved in the creation, production, distribution or
  52. delivery, of AVPVE has been advised of the existence or
  53. possibility of such damages.  In no event shall KAMI Ltd., any
  54. distributor of AVPVE, or anyone else involved in the creation,
  55. production, distribution or delivery of AVPVE be liable for
  56. any claim, whether in contract, tort, or any other theory of
  57. liability.

  59. Using AVPVE, it's utilities or documentaion means that you
  60. agree to these terms and conditions.

  62. Any other use, distribution or representation of the AVPVE is
  63. expressly forbidden without the written permission of KAMI Ltd.
  64. or an authorized distributor.

  66. Mass distribution of AVPVE in magazines or books requires
  67. approval from KAMI Ltd. or a authorized distributor of AVPVE.

  69. AVPVE may be made available on FTP and BBS sites, as well as,
  70. included on CD-ROMs containing other shareware or freeware
  71. programs, such as the SIMTEL and GARBO collection CD-ROMs,
  72. provided the conditions below are not violated.

  74. Any distribution of AVPVE is subject to the following
  75. restrictions:

  78. e do not want to have AVPVE distributed together with
  79. viruses, virus source code, virus construction programs or
  80. virus creation material such as 40Hex, Crypt or the Nuke
  81. newsletters.  Therefore,

  83. 1) AVPVE may not under any circumstances be made available on
  84. a site which makes viruses, virus source code, virus
  85. construction programs or virus creation material
  86. available.

  88. 2) AVPVE may not be included on a CD-ROM (or any media)
  89. containing viruses, virus source code, virus construction
  90. programs or virus creation material.

  92. 3) AVPVE may not be distributed as a part of a package
  93. containing viruses, virus source code, virus construction
  94. programs or virus creation material.

  96. We will consider legal action in the case of any violation of
  97. these three conditions.

  100. KAMI Ltd. and authorized distributors reserve the right to
  101. revise the AVPVE software, utilities and written
  102. materials, and to make changes from time to time in the
  103. contents without obligation to notify any person.

  108. All AVPVE programs, utilities and documentation are copyright
  109. 1992-1997 KAMI Ltd. All rights reserved. If any diskettes are
  110. provided with AVPVE they are not copy protected.

  112. The AVPVE programs, utilities and documentation are protected
  113. by copyright law, which applies to the computer software as
  114. well, except for that you may make copies of the software
  115. solely for backup or archive purposes and transfer the software
  116. to hard disk provided that the software is used as specified
  117. herein.
